TERMS OF SERVICE

These Terms of Service govern purchases from and use of the Sussex Sea & Sky online store.
Throughout these Terms, "Sussex Sea & Sky", "we", "us" and "our" refer to Sussex Sea & Sky. "You" and "your" refer to the customer or user of our website.
Our online store is powered by Shopify. Our physical fine-art photographic prints are manufactured and fulfilled using specialist print-on-demand production services.
By placing an order with Sussex Sea & Sky, you agree to these Terms together with the policies referred to in them.
Nothing in these Terms excludes or restricts any consumer right that cannot lawfully be excluded or restricted.
1. ABOUT OUR PRODUCTS
Sussex Sea & Sky sells photographic artwork as physical fine-art prints.
Our physical prints are produced individually following receipt of an order rather than being supplied from pre-manufactured inventory.
Product pages provide the available specifications for each product, which may include artwork, dimensions, paper or material, orientation, finish, framing and other options where applicable.
Please check your chosen artwork and product specifications carefully before completing your purchase.
2. PLACING AN ORDER
When you place an order, you are making an offer to purchase the products shown in your order.
You must provide accurate and complete information, including your name, delivery address, contact information and any product selections required to fulfil the order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- payment has not been authorised;
- a product cannot be manufactured or fulfilled;
- there is an obvious pricing or product-description error;
- we reasonably suspect fraud or misuse;
- the delivery address cannot reasonably be serviced; or
- fulfilling the order would breach applicable law.
If we cancel an order after payment has been taken and no product is supplied, we will refund the applicable amount.
3. PRICES AND PAYMENT
Prices are displayed on our website in the currency indicated at checkout.
The total amount payable will be shown before you complete your order, including applicable delivery charges and taxes where these are required to be shown or collected.
Payment must be successfully authorised using one of the payment methods offered at checkout.
We reserve the right to correct genuine pricing errors. If an obvious pricing error affects an order already placed, we will contact you and, where appropriate, give you the option of proceeding at the correct price or cancelling the affected order for a refund.
4. MADE-TO-ORDER PRODUCTION
Our physical fine-art photographic prints are manufactured following receipt of the customer's order.
We use a specialist print-on-demand production and fulfilment service to manufacture and dispatch our products.
Once an order has entered production, manufacture of the customer's selected product has commenced.
Please refer to our Returns, Cancellations & Refunds Policy for the rules concerning cancellation before and after production.
5. CANCELLATIONS AND MADE-TO-ORDER PRODUCTS
We provide a 24-hour cancellation window from the time an order is placed.
If you wish to cancel an order, please contact:

as soon as possible and within 24 hours of placing the order, quoting your order number.
Provided production has not commenced, we will cancel the order and issue the applicable refund.
Where goods are made to the consumer's specifications or are clearly personalised within the meaning of applicable consumer law, the statutory change-of-mind cancellation right does not apply.
Once production of such a made-to-order product has commenced, cancellation or modification cannot normally be accepted.
This does not affect your statutory rights where goods are faulty, damaged, incorrectly supplied, misdescribed or otherwise fail to conform to the contract.

6. DELIVERY
Products may be manufactured and dispatched directly to you by our specialist production and fulfilment partners.
Delivery estimates shown on our website or provided after ordering are estimates unless expressly stated otherwise.
We will take reasonable steps to arrange delivery within the timeframe applicable to your order and in accordance with our legal obligations.
Events outside our reasonable control, including carrier disruption, severe weather, customs delays and other circumstances beyond our reasonable control, may affect delivery.
Nothing in this section excludes any rights you have under applicable consumer law where goods are not delivered within a legally required or expressly agreed period.

7. DELIVERY INFORMATION
You are responsible for providing a complete and accurate delivery address when placing your order.

We cannot guarantee that a delivery address can be changed once an order has entered production or the fulfilment process.
Nothing in this section removes any responsibility that applicable law places on us concerning delivery of the goods.
8. DAMAGED, FAULTY OR INCORRECT GOODS
Goods supplied by Sussex Sea & Sky must comply with your statutory rights.
If your print arrives damaged, defective, incorrectly supplied, materially different from its description or otherwise fails to conform to the contract, contact us promptly at:

Please provide:
- your order number;
- a description of the problem;
- clear photographs showing the issue; and
- where relevant, photographs of the packaging.
Please retain the product and its packaging until we provide instructions.
Depending on the circumstances and your statutory rights, an appropriate remedy may include replacement, refund, repair where appropriate, or another remedy required by law.
Do not return a product to the manufacturing or sender address unless we specifically instruct you to do so.
Nothing in these Terms excludes or restricts your statutory rights.
9. PRODUCT IMAGES AND COLOUR
We take reasonable care to display our photographic artwork and products accurately.
However, screens and devices differ in brightness, calibration, colour profile, contrast and display technology. Ambient lighting can also affect how an image appears.
As a result, the appearance of a physical fine-art print may differ to some degree from its appearance on a phone, tablet or computer display.
Reasonable differences resulting from screen settings, display technology or viewing conditions do not necessarily mean that a correctly produced print is defective or misdescribed.
This does not affect your statutory rights where a product is genuinely faulty or materially different from its description.
10. PRODUCT DIMENSIONS
Product dimensions are stated on the relevant product page.
Please check dimensions carefully and measure your intended display location before ordering.
Ordering an incorrect size does not in itself make a correctly manufactured product faulty.
If you realise that you have selected an incorrect size after ordering, please contact us as soon as possible and within the applicable 24-hour cancellation window.
11. COPYRIGHT AND INTELLECTUAL PROPERTY
Unless expressly stated otherwise, the photographs, photographic images, artwork, product imagery, website imagery and other original creative material displayed or sold by Sussex Sea & Sky are protected by copyright and other applicable intellectual-property rights.
Copyright remains with the applicable copyright owner.
Purchasing a physical print gives you ownership of that individual physical copy. It does not transfer copyright or other intellectual-property rights in the underlying photograph or artwork.
Unless you have obtained our prior written permission or applicable law expressly permits the use, you must not:
- reproduce or copy our photographs or artwork;
- scan or digitally reproduce a purchased print;
- manufacture additional copies;
- sell reproductions;
- distribute high-resolution reproductions;
- use our photographs or artwork for commercial purposes;
- create products using our artwork; or
- license or otherwise commercially exploit our photographs or artwork.
Nothing in the sale of a physical print constitutes an assignment or transfer of copyright.

12. WEBSITE CONTENT
Content on our website is provided for the operation and promotion of Sussex Sea & Sky and our products.
You must not reproduce, systematically download, scrape, commercially exploit or republish protected website content in infringement of our intellectual-property rights or other applicable rights.
Normal browsing, sharing of ordinary links to our website and other uses permitted by law are unaffected.
13. ACCEPTABLE USE
You must not use our website:
- unlawfully or fraudulently;
- to interfere with its operation or security;
- to introduce malicious software;
- to attempt unauthorised access to systems or information;
- to infringe intellectual-property rights; or
- in any other manner prohibited by applicable law.
We may restrict access where reasonably necessary to protect our website, customers or business.
14. THIRD-PARTY SERVICES AND FULFILMENT
Our store uses third-party services including Shopify, payment providers, print-on-demand production and fulfilment services, and delivery companies.
These services enable us to process payments, manufacture products and deliver orders.
The use of third-party providers does not remove the rights you have against Sussex Sea & Sky under your contract with us or applicable consumer law.
Third-party websites or services may have their own terms and privacy policies where you interact directly with them.
15. PERSONAL INFORMATION
We process personal information in accordance with our Privacy Policy.
Our Privacy Policy explains the information we collect, why we process it, the service providers involved in operating and fulfilling our store, and your applicable data-protection rights.
16. LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot legally be excluded or restricted.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances for which we are not legally responsible.
Nothing in this section affects rights or remedies available to consumers under applicable law.
17. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delay or failure caused by circumstances outside our reasonable control to the extent permitted by law.
Where such an event materially affects an order, we will take reasonable steps to minimise its effects and communicate with you where appropriate.
Your statutory rights remain unaffected.
18. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business, products, services, fulfilment arrangements or applicable law.
The Terms applying to a particular purchase will ordinarily be those in effect when the order was placed, subject to any changes required by law.
The current version will be published on our website with its latest revision date.
19. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
20. GOVERNING LAW AND JURISDICTION
These Terms and contracts between us are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also have the benefit of mandatory protections provided by the law applicable where you live.
Nothing in these Terms deprives a consumer of mandatory legal protections or any right to bring proceedings in a court available to them under applicable law.
